Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and PayMaster Africa ("Company," "we," "us," or "our") concerning your access to and use of our payment services, including our WhatsApp-based platform and website.

By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our services.

1. Eligibility

To use PayMaster Africa services, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into binding contracts
• Provide accurate and complete registration information
• Not be prohibited from using our services under applicable laws
• Have a valid WhatsApp account and phone number
• Reside in a country where our services are available

We reserve the right to refuse service, terminate accounts, or cancel transactions at our discretion.

2. Account Registration and Security

2.1 Account Creation

When you create an account, you agree to provide accurate, current, and complete information. You must update your information promptly if it changes.

2.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Securing your WhatsApp account and phone number

2.3 Verification

We may require identity verification before you can use certain services. This may include submitting government-issued identification documents and proof of address.

3. Our Services

3.1 Payment Services

PayMaster Africa provides:

• WhatsApp-based money transfers
• Payment processing for merchants
• Mobile money integration
• Transaction history and reporting

3.2 Service Modifications

We reserve the right to modify, suspend, or discontinue any part of our services at any time, with or without notice. We are not liable for any modification, suspension, or discontinuance of services.

3.3 Service Availability

While we strive for 24/7 availability, we do not guarantee uninterrupted access to our services. Services may be unavailable due to maintenance, technical issues, or circumstances beyond our control.

4. Fees and Payments

4.1 Transaction Fees

We charge fees for certain transactions. All applicable fees will be clearly displayed before you complete a transaction. Fees are non-refundable except as required by law.

4.2 Payment Methods

You authorize us to charge your designated payment method for all fees. You are responsible for ensuring sufficient funds are available.

4.3 Currency Conversion

If currency conversion is required, we will use our current exchange rates. These rates may include a margin above interbank rates.

5. Prohibited Activities

You agree not to:

• Use our services for illegal activities or fraud
• Violate any laws or regulations
• Provide false or misleading information
• Impersonate another person or entity
• Interfere with or disrupt our services
• Attempt to gain unauthorized access to our systems
• Use our services for money laundering or terrorist financing
• Engage in any form of market manipulation
• Reverse engineer or copy our technology
• Send spam or unsolicited communications through our platform

6. Transaction Disputes

6.1 Reporting Disputes

If you believe a transaction was unauthorized or incorrect, you must notify us within 60 days of the transaction date. We will investigate and respond within a reasonable timeframe.

6.2 Resolution Process

We will work to resolve disputes fairly and promptly. However, we are not responsible for disputes between users regarding the quality of goods or services purchased.

7. Intellectual Property Rights

All content, features, and functionality of our services are owned by PayMaster Africa and are protected by international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works of our content without express written permission.

8. Limitation of Liability

To the maximum extent permitted by law, PayMaster Africa shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of our services.

Our total liability for any claims shall not exceed the amount of fees paid by you to us in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless PayMaster Africa, its affiliates, and their respective officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses arising from your use of our services or violation of these Terms.

10. Termination

We may suspend or terminate your account and access to our services:

• If you violate these Terms
• If we suspect fraudulent or illegal activity
• If required by law or regulatory authorities
• At our discretion for any reason

You may terminate your account at any time by contacting us. Upon termination, you remain liable for all outstanding obligations.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Ghana, without regard to its conflict of law provisions.

Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Ghana.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of our services after changes constitutes acceptance of the modified Terms.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
